STATEGIC BUSINESS PLANNING:  Once you have made the decision to franchise your business, a franchisor should develop a business plan outlining the company’s growth and strategy for the next five years to incorporate the franchise strategy. A franchisor needs certain new capabilities and will need to be sure that these capabilities are seamlessly integrated into existing organizational functionality.

FRANCHISE OPERATIONS MANUALS & TRAINING PROGRAMS:  To ensure successful franchisees and maintain quality control, you will need to develop a state-of-the-art operations manual for your franchisees. This manual will serve as both a marketing tool and as a measure to ensure your franchisees are benefitting from your experience which will in turn benefit your bottom line as they grow their earnings using your tried and tested methodology. As a sales tool, it demonstrates franchisor competence to new prospects. It also serves as a training guide for new franchisees, as a reference guide for established franchisees, as a “liability limiter” for the franchisor, and as a legally binding quality control device for the entire chain. To complement the competitive advantage you are giving your franchisees, the franchisor should also develop training programs for use in conjunction with the operations manual. Computer-based tools and programs are highly effective, as are training videos, and can be used for the franchisee, for the franchisee’s employees, and for corporate employees.

LEGAL DOCUMENTS:  To be legally entitled to sell franchises, the franchisor will need guidance on developing a franchise agreement and a FDD (Franchise Disclosure Document) which, in Manitoba, must be provided to the franchisee 14 days prior to the close of the franchise sale. British Columbia, Alberta, Ontario, New Brunswick, Prince Edward Island and Manitoba all have legislation in place regarding franchise agreements, sales and disclosure documents. The franchisor will also need to maintain ongoing compliance (keeping registrations in force while actively selling) and will need to be able to document compliance with provincial and federal law on an ongoing basis. Eagle will assist in the preparation of these documents which can then be reviewed by an attorney with franchise experience. (Companies seriously considering franchising are well advised to seek the counsel of a knowledgeable franchise professional prior to initiating any franchise efforts).
